MIST Bioscience, LLC (“MIST Bioscience,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect through our website at mistbioscience.com (the “Site”) and in the course of providing our products, services, and consulting (collectively, the “Offerings”), how we use and share that information, and the choices you have.

This Policy is incorporated into our Terms of Use. By using the Site or providing us information, you agree to this Policy.

 

1. Who We Are

MIST Bioscience, LLC is a biotechnology company that develops and sells research-use-only reagents and kits, provides related laboratory services and consulting, and makes software tools such as MIST Explorer™ available to customers. For privacy questions, contact us using the details in Section 13. We are the controller of the personal information described in this Policy.

 

2. Information We Collect

2.1 Information you provide to us. We collect information you give us directly, such as when you request a quote, place an order, create an account, contact us, subscribe to communications, or apply for a job. This may include:

• Contact and identity data — name, job title, organization, email address, phone number, and shipping and billing addresses;

• Order and transaction data — products or services requested, order history, and correspondence about your orders;

• Payment data — billing details and, where applicable, payment card or bank information (note: full payment card details are processed by our payment processor and are not stored by us — see Section 5);

• Account data — username and password if you create an account;

• Communications — the content of inquiries, support requests, and other correspondence; and

• Professional/research context — information you choose to share about your research, samples, or technical needs.

 

2.2 Information we collect automatically. When you visit the Site, we and our service providers may automatically collect:

• Device and usage data — IP address, browser type, operating system, referring/exit pages, pages viewed, links clicked, and dates/times of access; and

• Cookies and similar technologies — see Section 4.

 

2.3 Information from third parties. We may receive information about you from business partners, resellers, service providers, analytics providers, and publicly available sources, which we may combine with information we already hold.

 

2.4 Software. Software we make available, such as MIST Explorer™, runs locally on your own device. It does not transmit personal information back to us, and we do not collect usage, diagnostic, or license data from it through this Policy. We do not intentionally collect sensitive personal information or health information about you through the Site, and we ask that you not submit it. Note that biological samples or research data you send us in connection with a Service are governed by our Terms of Use and any applicable agreement, not by this Policy.

 

3. How We Use Information

We use the information we collect to:

• process and fulfill quotes, orders, and shipments, and provide Services and Consulting;

• create and manage accounts and provide customer support;

• communicate with you about orders, products, technical matters, and your requests;

• send marketing and informational communications where permitted, and manage your preferences (see Section 12);

• operate, maintain, secure, and improve the Site and our Offerings;

• understand how visitors use the Site through analytics;

• detect, prevent, and address fraud, security issues, and misuse;

• comply with legal, regulatory, tax, accounting, and export-control obligations; and

• establish, exercise, or defend legal claims.

 

We process your information only where we have a proper basis to do so — for example, to perform a contract with you, with your consent, to comply with a legal obligation, or for our legitimate business interests in operating and improving our Offerings in a way that does not override your rights.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Site, remember your preferences, analyze traffic, and improve performance. These may include:

• Strictly necessary cookies that enable core functionality;

• Analytics cookies (for example, Google Analytics) that help us understand Site usage; and

• Functional/preference cookies that remember your choices.

 

You can control cookies through your browser settings and, where offered, through our cookie banner or preferences tool. Disabling some cookies may affect Site functionality. Where required by law, we obtain consent before setting non-essential cookies. We currently [do / do not] respond to browser “Do Not Track” signals.

5. How We Share Information

We do not sell your personal information. We share information only as follows:

• Service providers. With vendors who perform functions on our behalf — such as payment processing, shipping and logistics, hosting, email and marketing platforms, analytics, and customer support — under contracts that limit their use of the information.

• Payment processors. Payment card transactions are handled by our third-party payment processor, which processes your payment data under its own privacy terms; we do not store full card numbers.

• Shipping carriers. With carriers as needed to deliver your orders.

• Professional advisors. With our accountants, auditors, lawyers, insurers, and bankers as needed.

• Legal and safety. When we believe disclosure is necessary to comply with law, legal process, or a government request; to enforce our agreements; or to protect the rights, property, or safety of MIST Bioscience, our customers, or others.

• Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred to the successor entity, subject to this Policy.

• With your consent. In other cases with your direction or consent.

6. Data Retention

We retain personal information for as long as needed to fulfill the purposes described in this Policy — including providing Offerings, maintaining business records, and complying with legal, tax, accounting, and export-control obligations — and then delete or de-identify it. Retention periods vary by the type of information and the applicable legal requirements.

7. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping any account credentials confidential.

 

8. Where We Process Information

We are based in and operate from the United States, and the information we collect is processed in the United States. If you access the Site from outside the United States, you understand that your information will be processed here, where data-protection laws may differ from those in your location. We do not currently market or sell to customers in the European Economic Area or the United Kingdom; if that changes, we will update this Policy to add the protections those laws require, such as a lawful basis for processing and appropriate safeguards for cross-border transfers.

Depending on where you live, you may have some or all of the following rights regarding the personal information we hold about you:

• to access the personal information we hold about you;

• to request correction of inaccurate information;

• to request deletion of your information;

• to opt out of marketing communications; and

• to withdraw consent where processing is based on consent.

 

California residents (CCPA/CPRA). If you are a California resident, you have the right to know what personal information we collect, use, and disclose; to request deletion or correction; and to be free from discrimination for exercising your rights. We do not sell or “share” (for cross-context behavioral advertising) personal information as those terms are defined under California law.

To exercise any right, contact us using Section 13. We will verify your request as required by law and respond within the timeframe the law allows. You may use an authorized agent where permitted. As our business grows or we begin serving customers in other regions, we will update this section to reflect any additional rights that apply.

10. Children’s Privacy

The Site and Offerings are intended for professional and research users and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, please contact us and we will take appropriate steps to delete it.

11. Third-Party Links

The Site may link to third-party websites and services that we do not control. This Policy does not apply to those sites, and we are not responsible for their privacy practices. We encourage you to review their privacy policies.

You can opt out of marketing emails at any time by using the unsubscribe link in the email or by contacting us. We may still send you non-promotional messages about your orders, account, or transactions. You can manage cookie preferences as described in Section 4.
